Check out ACE Scottish legal affiliate Brodies' latest update in relation to a decision of the Scottish Courts, which had struck down a pay less notice for failing to provide sufficient detail. Muir Construction Ltd v Kapital Residential Ltd was the first under the amended Construction Act to consider the detailed requirements of a pay less notice.
Brodies are not convinced that the case had any points of general application, the way in which the Pay Less Notice was put together was unusual and did not satisfy the basis of calculation.
